Terms & Conditions.
Original Artwork and Prints
The artist has the right to display all original artwork on any personal website or gallery.
The customer is prohibited from re-distributing, reproducing, or selling the artist’s artwork or profit from the artwork in any way.
The customer is free to post the work online providing that credit is given to the artist. Please respect the artist and do not claim the art as your own.
The artist has the right to sell multiple prints and copies of all original artwork.
The artist has the right to borrow the original artwork back if needed for exhibitions or art shows. In this case, the artist will arrange collection or cover the cost of postage.
The artist cannot be held responsible for any faults with the printing of artwork; prints are outsourced to a third-party. As such, we will try our best to rectify any issues that may arise but MADE BY NICOLE and the artist cannot be held responsible.
Payment/Refund terms:
Artwork must be paid for in full before the artwork is dispatched to the customer.
Payment confirms to the artist that the customer has read, understood and agreed to these terms and conditions as outlined on this page. Once this payment has been received, a contract will be deemed to have been made.
Prices are quoted in UK Pounds for all clients.
No refunds will be issued after original artwork(s) has been purchased by the customer.
Commissions
In exchange for an agreed fee, the artist will create artwork, carefully following a detailed description/brief provided by the customer.
The artist reserves the right to cancel a commission if the customer fails to communicate in a timely manner or exhibits inappropriate behaviour.
The artist holds the right to display all commissioned artwork on any personal website or gallery. However, in the case of the commissioned artwork being a gift, the artist will refrain from posting the work until the recipient has received it so as to not ruin the surprise.
The customer is prohibited from re-distributing, reproducing, or selling the artist’s artwork or profit from the artwork in any way.
The customer is free to post the work online providing that credit is given to the artist. Please respect the artist and do not claim the art as your own.
The artist maintains the right to sell prints of all commissioned work that is personal to customer (for example, a painting of a family member or partner).
Required client information:
The customer must provide a high-quality photo for the artist to reference before the creation process commences.
The customer must make the details of their desired commissioned work as specific and detailed as possible.
The customer must provide a preferred completion date for their commissioned artwork.
Payment/Refund terms:
A deposit valued at 40% of the commission price is required upon ordering your commission to confirm your order. The creation process will not commence until this deposit has been received. Please note that this deposit excludes the cost of postage and packaging (P&P).
Payment of the deposit confirms to MADE BY NICOLE that the customer has read, understood and agreed to these terms and conditions as outlined on this page. Once the deposit has been received, a contract will be deemed to have been made.
The customer must pay the remaining 60% of the commission price and the cost of P&P before the completed artwork is dispatched. The customer will be sent an invoice for the remaining balance once the customer is happy with the standard of the artwork produced.
If the customer does not pay the full amount within 30 days of being notified that the commission is complete, the artist retains full and exclusive ownership of the work. The work may subsequently be auctioned, resold, modified, destroyed or otherwise disposed of at the artist’s discretion.
Prices are quoted in UK Pounds for all clients.
The artist retains the right to increase the original commission price (within reason) should the customer request over four amendments be made to the artwork. Please note that this will only be done if absolutely necessary.
In the instance a customer completely changes their brief or decides they no longer want the artwork after it has been produced and completed (according to the original brief given), the customer is expected to pay the full amount for the work already done.
If the customer wishes to cancel a commission, they must notify the artist as soon as possible, but within two days. If the customer cancels within two days of placing their order, their deposit will be fully refunded. After two days, customers will not be refunded the 40% deposit if they decide to cancel.
No refunds of any amount will be paid to the customer once the commissioned art has been paid for in full.
Commission Completion Timescales:
Commissions are managed on a first come first served basis. The completion time is measured from when the deposit is received. The time period for the commission to be completed will depend on the number of commissions that are already confirmed ahead of yours. The size and complexity of your commission may also impact this timescale.
Whilst we will always try to meet estimated completion times, MADE BY NICOLE and the artist cannot be held responsible for any delays due to reasons out of their control.
